EL PRINCIPIO DE MUTUO RECONOCIMIENTO EN EL ÁMBITO DE LA UE Y LOS LÍMITES A LA LIBRE CIRCULACIÓN ¿MECANISMO CONCILIADOR EN TIEMPOS REVUELTOS?

RESUMEN: El presente trabajo analiza, desde el punto de vista de Derecho internacional privado, el alcance del principio de mutuo reconocimiento en la UE en el ámbito civil, mercantil y de la familia. Se realiza un acercamiento al tipo de situaciones jurídicas en las que puede resultar conveniente su operatividad y al papel que este principio desarrolla, en la actualidad, en relación con la libre circulación de factores productivos de la UE y, en especial, con el derecho fundamental de los ciudadanos de la UE a residir y circular libremente en el territorio de los Estados miembros.
ABSTRACT: This paper examines, from the point of view of private international Law, the scope of the principle of mutual recognition in the EU in civil, commercial and family matters. This paper is an approach to the type of legal situations in which it may be appropriate and the role that this principle developed, at present, in relation to the free movement of factors of production in the EU and, in particular, with the fundamental right of EU citizens to reside and move freely within the territory of the Member States.
